In advocating that we extend our experiment in political democracy in America to include economic democracy as well, the Bishops' Letter assumes the basic social nature of man. This leaves an enormous gap between the values and attitudes they recommend and the private and individualistic view of man that undergirds our traditional economic thinking. This essay attempts to bridge that gap in terms of a theory of practice, individual in emphasis, but bringing out the enabling conditions of any and all (...) practice without which practice would not be possible. It is suggested that these presuppositions of practice function normatively in all practice, economic as well as other types, and ought to be of interest to the practice of any adequately self-interested individual. In this paper I reconsider the Roman law on magic through an examination of three key “moments”: the Lex Cornelia de sicariis et veneficiis; the trial of Apuleius as known from his Apology; and a passage from The Opinions of Paulus. I argue that the Roman law on magic grounded in the Lex Cornelia gradually shifted from a focus on harmful and uncanny actions to a concern with religious deviance. This shift was already underway at the time of Apuleius' trial, (...) if only on an ad hoc basis, and was firmly established in the formal discourse of Roman law by ca. 300 CE, the date of The Opinions of Paulus. I argue for the importance of retaining “magic” as a heuristic category, since it is the only term fluid enough to function as an inclusive rubric for this shifting set of concerns. (shrink)

Among the more significant developments of the twentieth century, the widespread attention given to 'rights issues' must surely justify ranking it somewhere near the top. Never before has the issue of rights attracted such a wide audience or stirred so much controversy. Until very recently 'rights' were traditionally recognized as attributable only to humans. Today, we increasingly are hearing a call to extend 'rights' to the nonhuman animal and, on occasion, to the environment. In this book, James B. Reichmann, (...) S.J., undertakes an investigation of the metaethical grounds of 'rights' theory, with special focus on the controversial issue of whether creatures other than humans can and should be considered true subjects of 'rights.' He contends that before assigning rights to this or that individual or group, whether human or not, we need to be very clear about what it is we are assigning, to whom, and why. The book argues forcefully that the various recent efforts to build a case supporting animal and environmental 'rights' fail in their quest, and that any such effort resting on a Darwinian evolutionary base is likewise condemned to fail. In furtherance of this claim the author first investigates life phenomena, followed by a detailed comparative study of knowing, communicating and doing, as these are observed in the human and the nonhuman animal. This in turn is followed by an overview of diverse views advanced by contemporary environmental ethicists and animal 'rights' advocates, including Peter Singer, Tom Regan, J. Baird Callicott, Laura Westra, and Don E. Marietta, Jr. Representative though doubtless provocative conclusions drawn from this study include the claims that: (1) Classic Darwinian theory provides no admissable premise from which to derive a theory of inherent, inalienable rights. (2) No satisfactory explanation of the origin of rights and obligation can derive save from within the context of natural law theory. (3) The human person alone unqualifiedly possesses rights. (4) The view that vegetarianism is an ethical mandate is neither compatible with the Christian world view, nor philosophically sound. ABOUT THE AUTHOR: James B. In this article, we explore the tension between truth telling and the demands of civic life, with an emphasis on the tension between serving one's country and reporting the truth as completely and independently as possible. We argue that the principle of truth telling in journalism takes priority over the promotion of civic values, including a narrow patriotism. Even in times of war, responsible journalism must not allow a narrow patriotism to undermine its commitment to truth telling. Journalists best fulfill (...) their civic role by adopting the perspective of a democratic patriotism. We conclude that if news organizations accept the primacy of truth telling and democratic patriotism, they should not embed reporters with military units, or if they do, they have an ethical obligation to implement special editorial precautions. Most present-day scholarship on the carceral state, and practically all of the papers and discussion at this conference, involve analysis of the massive increase in prison population over the last 25 years. What has not yet been systematically explored, and what is meant to be the focus of this final panel, is how to decarcerate. This is practically virgin territory. Scholars and activists have hardly begun to create a conversation, much less a literature, on the politics and policy of decarceration. (...) My experience is that most people begin to think about decarceration as a problem in political persuasion. But that begs the questions: who needs persuading and of what? Even passing attention to the issue suggests that there are many possible paths to decarceration; each of them implicates policy choices and triggers its own political debate. (shrink)

Where Men Hide is a spirited tour of the dark and often dirty places men go to find comfort, camaraderie, relaxation, and escape. Ken Ross's striking photographs and James B. Twitchell's lively analysis trace the evolution of these virtual caves, and question why they are rapidly disappearing. They find that for centuries men have met with each other in underground lairs and clubhouses to conduct business or to bond and indulge in shady entertainments. From beginning to end, the poem is literally made up of relations…[that] constitute a method of contemplation and criticism, a way of inviting the reader to think in terms of one thing in terms of another. Consider, for example, Odysseus' trip to Chryse in book 1, a passage I never read without surprise: in this tense and heavily charged world, in which everything seems to have been put into potentially violent contention, why are we given this slow and deliberate journey, (...) so heavily formulaic in texture? The answer is that this is a ritual of reconciliation, a kind of healing, which will receive its most ample performance at the great movement in book 24 when Achilles and Priam share their sorrows. A movement begins here that will run throughout the poem.It is by such an art of arrangement, by placing one thing against another, that Homer criticizes the world of book 1 with which he began; not, as we expect of a writer today, by elaborating competitive languages of motives and value but by ordering his materials into patterns of experience that teach the reader something different from anything the material itself seems to say.1 In a way the poem, as a whole thus has the form of argument; not, of course, argument in the ratiocinative sense of a thesis supported by propositions, from which it can be said to proceed by the rules of logic or the laws of probability, but argument as an activity of critical engagement, a definition of resources and a testing of limits, that results in the creation of a new position taken by the writer and offered to the reader. A key question in disability studies, philosophy, and bioethics concerns the relationship between disability and well-being. The mere difference view, endorsed by Elizabeth Barnes, claims that physical and sensory disabilities by themselves do not make a person worse off overall—any negative impacts on welfare are due to social injustice. This article argues that Barnes’s Value Neutral Model does not extend to intellectual disability. Intellectual disability is (1) intrinsically bad—by itself it makes a person worse off, apart from a non-accommodating environment; (...) (2) universally bad—it lowers quality of life for every intellectually disabled person; and (3) globally bad—it reduces a person’s overall well-being. While people with intellectual disabilities are functionally disadvantaged, this does not imply that they are morally inferior—lower quality of life does not mean lesser moral status. No clinical implications concerning disability-based selective abortion, denial of life-saving treatment, or rationing of scarce resources follow from the claim that intellectual disability is bad difference. Metaphysical and epistemological dualism informs much contemporary discussion of the relationships of science and religion, in particular in relation to the neurosciences and the religious understanding of the human person. This dualism is a foundational artifact of modern culture; however, contemporary scientific research and historical theological scholarship encourage a more holistic view wherein human personhood is most fittingly understood as an emergent phenomenon of, but not simply reducible to, evolutionary and developmental neurobiology.

This paper draws from the turnover and emotions literatures to explore how job embeddedness, in the context of abusive supervision, can impact job frustration, citizenship withdrawal, and employee deviance. Results indicate that employees with abusive supervisors were more likely to be frustrated with their jobs and engage in more deviance behaviors. And yet, the relationship between abusive supervision and job frustration was moderated by job embeddedness such that the relationship was weaker and negative for those higher in job embeddedness and (...) stronger and positive for those lower in job embeddedness. In other words, contrary to our original predictions, individuals who were more embedded in their jobs with an abusive supervisor were actually less likely to experience job frustration or engage deviance behaviors. This study examined how sales managers react to ethical and unethical acts by their salespeople. Deontological considerations and, to a much lesser extent, teleological considerations predicted sales managers' ethical judgments. Sales managers' intentions to reward or discipline ethical or unethical sales force behavior were primarily determined by their ethical judgments. An organization's perceived ethical work climate was not a significant predictor of sales managers' intentions to intervene when ethical and unethical sales force behavior was encountered.

In both aspects, Holmes echoes Dei Verbum (DV, §§2, 13). However, rather than pursuing (...) a revelation-historical organization or beginning with Scripture's texts to derive conclusions about its nature and purpose, the book takes a "top-down" (13) approach to bibliology. In this way, its strength is the theological framing or refraining it gives to common questions.The first three chapters culminate, he claims, in a "definition of Scripture" (11). Beginning with the Trinity and creation, Holmes argues that all things have their being by participating in the inner life (the Word) of the Father, thus reflecting him, and that the Spirit drives creatures "toward the pattern of the Son" (33). God desires creatures to be good and causes of goodness in others, patterned after and in the Son through the Spirit's impulse to return them to God. In the Incarnation, God "reconciles nature with grace" (39) and in Christ perfects these desires. In Christ, man is now "included in the life of the Trinity" (37) and an agent of revelation, reflects God perfectly, and in love sends the Spirit to return humans to God through himself. This leads to reflections on Scripture directly. "Scripture is meant to impress the interior life of the Church on each generation; put another way, it is meant to impress Christ the Head on the members of his Mystical Body" (69). This brings Holmes to the topics of inspiration and canon. In order for human texts to impress Christ on his members, to communicate the divine through human means, "God himself" must be "addressing the [End Page 393] heart of the believer" (72). He makes a case for canon by pointing to the communal nature of humans. Tradition and canon, by which truth as a common good is formulated for a society, order and inform the society regarding its purpose, history, and character. "Tradition," then, "is good for man as man" (57) even in natural society, and all the more so in the supernatural society, the Church. The "texts that embody and transmit the tradition" (63) give continuity and life to the organism that is the Church, while within that tradition these texts can function as a sort of "guide rail" and a "mirror" of its identity (67).This overall view of Scripture lends perspective to particular topics (chs. 4-12). Turning to Scripture's authorship and inspiration, Holmes emphasizes again that God means humans to be real causes of revelation as God "attaches his voice" to their writing (82, 91, and throughout). This may, in differing circumstances, involve endowing them with particular and even unusual graces, many of which God grants to others who hand on revelation (such as Augustine), but in the case of the biblical authors the ("only") difference is that God "intended" biblical texts like Luke "to sound not only Luke's voice but God's voice as well" (91). His "general account of the fact of biblical difficulties" (202), then, depicts the human "author's soul" as "like the body of an instrument, determining the overtones of everything he writes" (208). God writes the notes to be played and selects the instruments, and God "asserts what the human author asserts" (210). But the particularities of an author's soul (and upbringing, assumptions, etc.) can be seen in anything from grammatical infelicities in Paul to the author's assumptions about a geocentric solar system, the goodness of killing the Canaanites, or Qoheleth's unawareness of an afterlife. God attaches his voice to their writing, and these instruments play "only God's note" (219), but God "does not affirm or deny" the assumptions or unasserted views of the author when writing (209). The specification of specific and often unique fates to individual cells as a function of their position within a developing organism is a fundamental process during the development of multicellular organisms. The development of the Drosophila embryonic central nervous system serves as an excellent model system in which to clarify the developmental mechanisms that link pattern formation to cell-type specification. The Drosophila embryonic central nervous system develops from a set of neural stem cells termed neuroblasts. Neuroblasts arise from the ectoderm (...) in an invariant pattern, and each neuroblast acquires a unique fate based on its position within this pattern. Two groups of genes recently have been demonstrated to govern the individual fate specification of neuroblasts. One group, the segment polarity genes, enables neuroblasts that develop in different anteroposterior positions to acquire different fates. The second group, referred to as the columnar genes, ensures that neuroblasts that develop in different dorsoventral domains assume different fates. When integrated, the activities of the segment polarity and columnar genes create a Cartesian coordinate system that bestows unique fates to individual neuroblasts as a function of their position of formation within the ectoderm. FRANCISCO SUÁREZ, THE GREAT JESUIT PHILOSOPHER AND THEOLOGIAN, has long been recognized as a pivotal figure in the development of Western philosophy. His thought is heavily indebted to the medieval philosophical tradition but also bears striking intimations of key themes in modern thought. In this paper I address one of the most controversial questions related to the thought of Suárez, namely, his relationship to the nominalist tradition. However, I shall do so rather indirectly by focusing not on explicit metaphysical questions (...) but rather on his account of our acquisition of universal concepts and its foundation in reality. By placing questions about the knowledge of singular and universal at the center of the discussion, I hope to shed new light on his account of the objectivity that we can have in our knowledge. The sixteenth-century philosopher Jacopo Zabarella stands near the end of the long Aristotelian dominance of western academic philosophy. Yet, despite the fact that Aristotelianism was soon to be overwhelmed by other currents of thought, Zabarella’s influence on western thought would continue into at least the nineteenth century, and he still provides useful discussions relevant to today’s Aristotle scholars. In what follows, I discuss the existence and essence of matter, and show how Zabarella argues for his claims. What is especially notable (...) about the existence and essence of matter as a topic is that matter is clearly at the center of his well-known interest concerning the nature of scientific methodology. In describing his seven and a half years as a prisoner of war in North Vietnam, the late Vice Admiral James B. Stockdale has said: "In that atmosphere of death and hopelessness, stripped of the niceties, the amenities of civilization, my ideas on life and leadership crystallized." Despite torture, intimidation, and isolation, Stockdale fulfilled his duties as senior officer among the prisoners with intelligence and courage, defining rules of conduct and maintaining morale. He often described the intense pressures of (...) that situation as a "melting" experience, in which preconceived feelings, fears, and bias melt as one comes to realize that, under the gun, you must grow or fail—or, in some cases, grow or die. This collection of his essays and speeches from the 1980s and 1990s reinforces how that experience formed a lifelong basis for his philosophical thought on issues of character, leadership, integrity, personal and public virtue, and ethics.
